Where a recruitment agency is the fee-payer in a supply chain; meaning there is no other agency between your business and the end client; you are responsible for operating PAYE and NICs on contractor payments where the end client has determined the contractor is inside IR35. The end client issues a Status Determination Statement. If the contractor is inside IR35, the fee-payer (typically the agency) must operate PAYE on the payment to the contractor's personal service company, deducting income tax and employee NICs before remitting to the contractor's company.
